Hive Merchant - Terms and Conditions

These Terms and Conditions govern access to and use of Hive Merchant, including our website, dashboard, storefronts, checkout, order history, delivery tools, analytics, and related services.
By creating an account, managing a store, placing an order, subscribing to paid features, or otherwise using Hive Merchant, you agree to these Terms.
1. About Hive Merchant
Hive Merchant is a commerce platform operated as part of the 212 Hive ecosystem from Morocco. Hive Merchant is currently operated by Imad Atyat-Allah.
Hive Merchant helps businesses create online storefronts, manage catalogs, receive customer orders, configure pickup and delivery options, and organize commerce operations.
Hive Merchant may include:
- Merchant dashboards, organizations, members, and storefronts.
- Store profiles, social links, product catalogs, categories, products, images, tags, modifiers, availability controls, and media uploads.
- Carts, authenticated checkout, customer profiles, order history, order management, reviews, analytics, and customer support tools.
- Pickup locations, city delivery pricing, delivery zones, driver selection, delivery assignment workflows, and delivery provider fields.
These Terms apply to Hive Merchant only unless another 212 Hive product or agreement says otherwise. They are product terms, not legal advice.
2. Who Can Use Hive Merchant
You may use Hive Merchant only if you:
- Are legally able to enter into a binding agreement.
- Use the platform for lawful business and customer ordering purposes.
- Provide accurate and complete information.
- Comply with these Terms, our policies, third-party service rules, and applicable laws.
If you use Hive Merchant on behalf of a business, organization, store, brand, or client, you confirm that you have authority to accept these Terms for that party.
3. Your Account and Security
To use certain merchant or customer features, you must create an account and may need to verify your email address or phone number.
You are responsible for:
- Keeping your login information secure.
- All activity under your account, organization, store, and checkout profile.
- Providing accurate account, business, store, customer, order, and contact information.
- Updating your information when it changes.
- Not sharing access with unauthorized people.
You must notify us immediately if you believe your account has been compromised. We may suspend or restrict access if we believe an account is being used unlawfully, fraudulently, abusively, or in violation of these Terms.
4. Your Store and Public Content
Merchants can create and manage public storefronts through Hive Merchant. You are responsible for all store names, handles, bios, logos, cover images, social links, categories, products, menus, prices, images, descriptions, modifiers, tags, availability, delivery settings, pickup locations, policies, and information displayed on your store.
Your store content must not:
- Be false, misleading, deceptive, or impersonating another person, business, brand, or organization without permission.
- Violate any law, regulation, third-party right, intellectual property right, privacy right, or platform rule.
- Contain illegal, harmful, abusive, hateful, exploitative, fraudulent, or unsafe content.
- Promote prohibited, restricted, counterfeit, stolen, dangerous, or improperly licensed products or services.
- Mislead customers about pricing, taxes, fees, availability, product quality, delivery, pickup, refunds, cancellations, affiliation, or ownership.
We may remove, restrict, hide, or disable store content if we believe it violates these Terms, our policies, third-party platform requirements, or applicable law.
5. Merchant Responsibilities
As a merchant, you are responsible for:
- The products or services you offer and all related descriptions, prices, photos, taxes, fees, modifiers, availability, and claims.
- Accepting, confirming, preparing, fulfilling, delivering, cancelling, refunding, replacing, or rejecting orders.
- Setting accurate delivery areas, city prices, pickup locations, opening hours, product availability, and orderability settings.
- Communicating with customers and handling complaints, disputes, reviews, returns, refunds, exchanges, and support.
- Complying with consumer protection, advertising, tax, invoicing, licensing, food safety, delivery, privacy, data protection, and business obligations.
- Protecting customer data you access through your store and using it only for legitimate business purposes.
Hive Merchant provides tools. It does not replace your legal, tax, accounting, operational, delivery, customer service, or compliance responsibilities.
6. Customer Orders and Checkout
Hive Merchant helps customers build carts, select products and modifiers, choose pickup or delivery where available, and place orders with merchants.
Unless clearly stated otherwise, the sale is between the merchant and the customer. Hive Merchant is not the seller of the products or services listed on a storefront.
Customers are responsible for:
- Providing accurate name, email, phone number, delivery address, pickup selection, and order information.
- Using an email address that matches their verified account when required by checkout.
- Reviewing cart items, modifiers, quantities, delivery fees, pickup details, and totals before placing an order.
- Communicating with the merchant about order changes, delivery problems, cancellations, refunds, and support.
Merchants are responsible for confirming availability, preparing orders correctly, updating order status, arranging pickup or delivery, and providing customer support.
7. Pickup, Delivery, and Locations
Hive Merchant may allow merchants to configure pickup locations, store locations, opening hours, city delivery pricing, delivery zones, local delivery, driver selection, delivery assignments, and provider-related delivery information.
Merchants are responsible for:
- Providing accurate pickup and delivery information.
- Setting correct delivery areas, fees, availability, and location details.
- Choosing, managing, and supervising drivers or delivery providers.
- Handling delayed, failed, cancelled, damaged, incorrect, or missing deliveries.
- Informing customers about delivery conditions, timing, restrictions, and fees.
If third-party drivers, delivery providers, maps, messaging tools, or logistics services are used, their own terms, pricing, availability, privacy policies, and service conditions may apply.
Hive Merchant is not responsible for delays, losses, damages, refusals, provider failures, or delivery issues caused by merchants, customers, drivers, or third-party delivery providers, unless required by law.
8. Payments and External Transactions
Hive Merchant does not currently process online payments inside the platform.
Merchants are responsible for choosing and managing accepted payment methods, such as cash on delivery, bank transfer, in-person payment, WhatsApp, or another method agreed directly with the customer.
Any payment made outside Hive Merchant is handled directly between the merchant and the customer. Hive Merchant is not responsible for failed payments, unpaid orders, payment disputes, refunds, chargebacks, fraud, external payment issues, or cash handling.
If Hive Merchant introduces online payments, payment terminals, cards, or other financial services in the future, those features may be subject to additional terms, verification, provider approval, pricing, and legal requirements.
9. Fees and Paid Features
Some Hive Merchant features may be free, paid, or available under a subscription plan. Pricing, billing cycles, included features, usage limits, commissions, or platform fees may be shown on our website, dashboard, or in a separate agreement.
If you subscribe to a paid plan or use paid features, you agree to pay the applicable fees. Unless stated otherwise, fees are non-refundable, plans may renew automatically, and you are responsible for taxes or charges related to your use of the platform.
If payment for a paid plan or feature fails, we may suspend, downgrade, or limit access to paid features.
10. Prohibited Products and Activities
You may not use Hive Merchant to publish, sell, promote, deliver, or facilitate:
- Illegal products, services, content, or activities.
- Fraud, scams, phishing, malware, spyware, spam, or unauthorized mass messaging.
- Counterfeit, stolen, dangerous, regulated, recalled, unsafe, or restricted goods without proper authorization.
- Drugs, controlled substances, weapons, or products or services requiring licenses you do not have.
- Adult, sexually explicit, exploitative, abusive, hateful, harassing, threatening, violent, or unsafe products, services, or content where prohibited by our policies or applicable law.
- Content or products that infringe intellectual property, privacy, publicity, consumer protection, or other rights.
- Any product, service, delivery, transaction, or activity prohibited by applicable law, third-party platform rules, or our policies.
We may update prohibited product and activity rules at any time and may suspend, remove, or restrict stores that violate this section.
11. Reviews, Analytics, and Store Performance
Hive Merchant may provide reviews, ratings, store views, product clicks, order metrics, traffic charts, and other analytics. Analytics are estimates and may be incomplete, delayed, duplicated, blocked, or affected by devices, browsers, privacy settings, network conditions, and third-party services.
Merchants must not manipulate reviews, submit fake reviews, pressure customers to leave misleading reviews, or use analytics in a deceptive way.
We may moderate, hide, or remove reviews if we believe they violate law, our policies, or the rights of others.
12. Intellectual Property
Merchants keep ownership of content they upload or publish through Hive Merchant, subject to any rights held by others.
By using Hive Merchant, you give us permission to host, store, process, display, reproduce, resize, format, distribute, and otherwise use your store content as needed to provide, secure, improve, promote, and support the service.
Hive Merchant, 212 Hive, our software, dashboards, storefront templates, designs, branding, and platform technology are owned by us or our licensors. You may not copy, reverse engineer, resell, or misuse the platform except as allowed by these Terms.
13. Privacy and Data Responsibilities
Our Privacy Policy explains how we collect and use personal information. By using Hive Merchant, you agree that we may process information as described in that policy.
Merchants may receive customer personal information through storefronts, carts, checkout, order history, reviews, delivery workflows, and support. Merchants are responsible for using customer data lawfully, protecting it, deleting or correcting it when legally required, and not selling, misusing, or spamming customers.
Customers should avoid submitting unnecessary sensitive information in order notes, review comments, messages, or other free-text fields.
14. Platform Availability and Changes
We work to keep Hive Merchant available and reliable, but we do not guarantee uninterrupted, error-free, or permanent access.
The platform may be unavailable because of maintenance, updates, outages, third-party service issues, security events, internet problems, or changes to our business or technology.
We may add, remove, suspend, rename, limit, or change features, dashboards, storefront tools, checkout behavior, delivery tools, analytics, integrations, free plans, paid plans, or usage limits at any time.
15. Suspension and Termination
We may suspend, restrict, remove, or terminate your account, organization, store, products, orders, reviews, delivery tools, or access to the service if:
- You violate these Terms, our policies, or applicable law.
- Your content, products, delivery activity, orders, or business operations create risk for Hive Merchant, users, customers, service providers, third parties, or the public.
- You use the platform for fraud, abuse, spam, harmful activity, unauthorized data collection, unsafe commerce, or security attacks.
- We are required to do so by law, court order, government request, or third-party platform requirement.
- You fail to pay fees for paid features where applicable.
You may stop using Hive Merchant at any time. Some information may be retained as described in our Privacy Policy.
16. Disclaimers and Limitation of Liability
Hive Merchant is provided on an as-is and as-available basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
To the fullest extent allowed by law, Hive Merchant and its operator will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for losses caused by merchants, customers, drivers, delivery providers, third-party services, external payments, user content, order disputes, outages, analytics errors, or unauthorized access.
17. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we may notify users through the platform, by email, or by posting an updated version on our website.
Your continued use of Hive Merchant after changes become effective means you accept the updated Terms.
18. Governing Law and Contact
These Terms are governed by the laws of Morocco unless mandatory law requires otherwise.
