Hive Tap - Terms and Conditions

These Terms and Conditions govern access to and use of Hive Tap, including our website, dashboard, merchant loyalty programs, customer tap pages, QR and manual passes, rewards, analytics, and related services.

By creating an account, configuring or joining a loyalty program, issuing or redeeming stamps, or otherwise using Hive Tap, you agree to these Terms.

1. About Hive Tap

Hive Tap is a digital loyalty platform operated as part of the 212 Hive ecosystem from Morocco. Hive Tap is currently operated by Imad Atyat-Allah.

Hive Tap helps cafés, restaurants, shops, and other businesses run digital stamp-card loyalty programs. Customers can join a merchant's program, present a short-lived QR or manual pass, collect stamps, and redeem eligible rewards.

Hive Tap may include merchant dashboards, merchant and team access, customer loyalty pages, QR codes, digital stamp cards, reward settings, customer histories, redemption records, analytics, and related services.

These Terms apply to Hive Tap only unless another 212 Hive product or agreement says otherwise. They are product terms, not legal advice.

2. Who Can Use Hive Tap

You may use Hive Tap only if you are legally able to enter into a binding agreement, provide accurate information, use the platform for lawful purposes, and comply with these Terms, our policies, third-party rules, and applicable laws.

If you create or manage a program for a business, organization, or client, you confirm that you have authority to accept these Terms and configure the program for that party.

Customers may join and use a loyalty program only under the rules set by the merchant and these Terms. Merchants are responsible for deciding whether participation is appropriate for their customers and location.

3. Accounts, Merchants, and Security

Some features require an account and may require email or phone verification. You are responsible for keeping your login details secure and for all activity under your account, organization, merchant profile, and team access.

Merchant information, including business name, city, email address, public URL, and reward program settings, must be accurate and kept up to date.

You must notify us promptly if you believe your account has been compromised. We may suspend or restrict access where we reasonably believe there is fraud, abuse, unauthorized access, or a violation of these Terms.

4. Loyalty Programs, Stamps, and Rewards

Each merchant is responsible for its own loyalty program, including its stamp threshold, reward label, collection behavior, redemption behavior, availability, eligibility, and any additional conditions it communicates to customers.

A stamp, reward status, QR code, manual pass, customer history, or dashboard record is a platform record used to support the merchant's loyalty program. It is not cash, stored value, a payment instrument, or a promise by Hive Tap to provide a merchant's reward.

Merchants must honor the programs they publish unless a lawful, clearly communicated, and reasonable limitation applies. Merchants are solely responsible for fulfilling rewards, resolving customer questions, and complying with consumer, tax, promotional, and sector-specific requirements.

Hive Tap does not determine the quality, legality, safety, availability, price, or suitability of a merchant's goods, services, visits, stamps, or rewards.

5. Customer Passes and Staff Actions

Hive Tap may create a short-lived, single-use customer pass for a merchant program. A customer may present it as a QR code or manual code for a merchant team member to review and confirm.

Merchants and their authorized staff must issue stamps and confirm redemptions only for genuine, eligible customer activity. They must not create, scan, share, reuse, alter, or approve passes dishonestly or outside the merchant's program rules.

Customers must not share, copy, manipulate, replay, or use another person's pass, account, stamps, or reward without permission. A pass may expire, be consumed, or fail to work after use, expiry, security controls, connectivity issues, or other operational limits.

We may reverse, restrict, investigate, or remove stamps, rewards, passes, accounts, or program access where we reasonably suspect error, fraud, abuse, or a breach of these Terms.

6. Merchant Content and Conduct

Merchants are responsible for their names, descriptions, contact details, program terms, reward labels, QR displays, staff conduct, goods, services, customer communications, and all information made available through Hive Tap.

You may not use Hive Tap for fraud, deceptive loyalty offers, impersonation, unauthorized data collection, spam, security attacks, illegal goods or services, or content that is harmful, abusive, discriminatory, infringing, or otherwise unlawful.

We may remove, restrict, hide, or disable merchant content or access if we believe it violates these Terms, our policies, third-party requirements, or applicable law.

7. Analytics and Records

Hive Tap may provide customer counts, stamp activity, redemption activity, visit histories, and other program analytics. These records and analytics are operational estimates and may be incomplete, delayed, duplicated, unavailable, or affected by devices, browsers, connectivity, user actions, privacy settings, security controls, and third-party services.

Merchants must not treat Hive Tap analytics as accounting, tax, legal, financial, or consumer-record evidence without independently verifying the relevant information.

8. Fees and Paid Features

Hive Tap features may be free, paid, or offered under a subscription plan. Pricing, billing cycles, included features, customer limits, locations, or other usage limits may be shown on our website, dashboard, or in a separate agreement.

If you use paid features, you agree to pay the applicable fees. Unless stated otherwise, fees are non-refundable, plans may renew automatically, and you are responsible for taxes and charges connected with your use of the service.

If payment fails, we may suspend, downgrade, or limit access to paid features.

9. Intellectual Property

Users and merchants keep ownership of content they provide to Hive Tap, subject to the rights of others.

By using Hive Tap, you give us permission to host, store, process, display, and use that content as needed to provide, secure, improve, promote, and support the service.

Hive Tap, 212 Hive, our software, branding, designs, and platform technology are owned by us or our licensors. You may not copy, reverse engineer, resell, or misuse the platform except as allowed by these Terms.

10. Privacy and Data Responsibilities

Our Privacy Policy explains how we collect and use personal information. By using Hive Tap, you agree that we may process information as described in that policy.

Merchants may access limited customer loyalty information relevant to their own program, such as customer identity shown in the dashboard, membership status, stamp totals, and activity history. Merchants must use this information only for legitimate program operation and in compliance with applicable privacy and marketing laws.

Merchants must provide any notices and obtain any permissions required for their own customer communications, promotions, or data uses. They must not use Hive Tap to collect sensitive information, credentials, payment details, or personal data deceptively, unlawfully, or unsafely.

11. Platform Availability and Changes

We work to keep Hive Tap available and reliable, but we do not guarantee uninterrupted, error-free, or permanent access. The platform may be unavailable because of maintenance, updates, outages, security events, internet problems, or third-party service issues.

We may add, remove, suspend, rename, limit, or change features, plans, integrations, analytics, program settings, and usage limits at any time.

12. Suspension and Termination

We may suspend, restrict, remove, or terminate an account, merchant, program, customer membership, pass, stamp, reward, or access to Hive Tap if you violate these Terms or law; create risk for users, customers, merchants, service providers, or the public; engage in fraud or abuse; fail to pay applicable fees; or where we are required to act by law, court order, government request, or third-party requirement.

You may stop using Hive Tap at any time. Some information may be retained as described in our Privacy Policy.

13. Disclaimers and Limitation of Liability

Hive Tap is provided on an as-is and as-available basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

To the fullest extent allowed by law, Hive Tap and its operator will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for losses caused by merchant programs, rewards, goods or services, staff actions, customer activity, fraud, third-party services, outages, analytics errors, or unauthorized access.

14. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we may notify users through the platform, by email, or by posting an updated version on our website.

Your continued use of Hive Tap after changes become effective means you accept the updated Terms.

15. Governing Law and Contact

These Terms are governed by the laws of Morocco unless mandatory law requires otherwise.
